TERMS OF SERVICE

These Terms of Service ("TOS") apply to use of IsleLife Media Limited services ("Services"), which include but are not limited to the services available on affiliated web site starterdex.com. By accessing and using these Services, you accept and agree to be bound by the terms and provision of the TOS. IsleLIfe Media Limited reserves the right, at its sole discretion, to change, add or remove portions of these TOS, at any time without notice to you. It is your responsibility to check these TOS each time before using these Services. Your continued use of these Services following the posting of changes will mean that you accept and agree to the changes.
1. USER OBLIGATIONS
By accessing these Services and any affiliated web site you the ("User") agree that you will not gain or attempt to gain unauthorized access to these Services or assist others in making such attempts, or distributing instructions, software or tools for that purpose. You will not use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of these Services, or in any way reproduce or circumvent the navigational structure or presentation of these Services to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through these Services. You will not send unsolicited email to a User or use these Services to collect information that will be used to stalk, abuse or in any way harass another. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that IsleLife Media Limited does not control the Content posted via these Services and, as such, does not guarantee the accuracy, integrity or quality of such Content. In the case of goods and services being offered by Users of the IsleLifeMedia Limited Services, you understand that IsleLifeMedia Limited is acting as an idependent third party between Users offering goods and services and IsleLifeMedia Limited is not resposible for: (a) the procurement of such goods or services, (b) the prices of such goods and serviced, (c) the quality of such goods or services (d) any damages or injury that may result from receiving or ushering such goods or services. You understand that by using these Services, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will IsleLife Media Limited be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via these Services.
2. YOUR REGISTRATION OBLIGATIONS
Certain Services require you to first create a member account and password. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify IsleLife Media Limited of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. IsleLife Media Limited cannot and will not be liable for any loss or damage arising from your failure to do so. In consideration of your use of these Services, you agree that you are of legal age to form a binding contract and are not a person barred from receiving these Services under the laws of applicable jurisdictions. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the these Service's registration form and (b) maintain and promptly update the registration information to keep it true, accurate, current and complete (c) to not use anyone else's password or member account at any time and to not allow others access to your password or member account (d) that you, and not IsleLife Media Limited, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via these Services. You also agree that IsleLife Media Limited may, in its sole discretion and without prior notice to you, terminate or limit your access to these Services and your member account and refuse any and all current or future use of the these Services (or any portion thereof)for any reason, including but not limited to (1) attempts to gain unauthorized access to the Site or assistance to others' attempting to do so, (2) attempting to overcome or overcoming software security features limiting use of or protecting any Services, (3) attempted or actual discontinuance or material modification of these Services, (4) violations of these Terms of Use, (5) failure to pay for purchases or Services that require payment, (6) suspected or actual copyright infringement, (7) unexpected operational difficulties, or (8) requests by law enforcement or other government agencies. You understand that there are members that are described as "partners" and that this term partners is used solely as a way of designating members with access to special Services. In no way does this term partners constitute a legal business partnership in any way and this term is partners is seperate from any partners that are mentioned in other parts of this TOS. You agree that IsleLife Media Limited will not be liable to you or to any third party for termination of your access to these Services.
3. PRIVACY POLICY
You understand that through your use of these Services you consent to the collection and use of registration information, including the transfer of this information to the United States and/or other countries for storage, processing and use by IsleLife Media Limited and its affiliates. While IsleLife Media Limited takes reasonable steps to safeguard and to prevent unauthorized access to your personal information, we cannot be responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied, or otherwise, that we will prevent unauthorized access to your private information. IN NO EVENT SHALL ISLELIFE MEDIA LIMITED OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY'S UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER ISLELIFE MEDIA LIMITED WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.
4. MEMBER CONDUCT
In connection with your account, these Services, other Users, or third parties, you agree not to: a. Breach these TOS; b. upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, religiously, or otherwise objectionable; c. impersonate any person or entity, including, but not limited to, a IsleLife Media Limited official, or falsely state or otherwise misrepresent your affiliation with a person or entity; d. upload, post, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); e. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; f. intentionally or unintentionally violate any applicable local, national or international law; g. refuse to cooperate in an investigation or provide confirmation of your identity or any registration information you provide to us; You acknowledge, consent and agree that IsleLife Media Limited may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce the TOS; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of IsleLife Media Limited, its users and the public.
5. DEALINGS WITH ADVERTISERS
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the IsleLife Media Limited Services, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that IsleLife Media Limited shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the IsleLife Media Limited Services.
6. GENERAL PRACTICES REGARDING USE AND STORAGE
You acknowledge that IsleLife Media Limited may establish general practices and limits concerning use of the these Services, including without limitation the maximum number of days that messages, postings or other uploaded Content will be retained by the IsleLife Media Limited Services, the maximum number of messages that may be sent from or received by an account on the IsleLife Media Limited Services, the maximum size of any message that may be sent from or received by an account on the IsleLife Media Limited Services, the maximum number of days that messages postings or other uploaded Content will be made available to Users.
7. CONTENT SUBMITTED OR MADE AVAILABLE FOR INCLUSION ON THE ISLELIFE MEDIA LIMITED SERVICES
IsleLife Media Limited does not claim ownership of Content you submit or make available for inclusion on the IsleLife Media Limited Services. However, with respect to Content you submit or make available for inclusion on areas of the IsleLife Media Limited Services, you grant IsleLife Media Limited the following worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the IsleLife Media Limited Services solely for the purposes of providing and promoting the specific area or Content on the IsleLife Media Limited Services to which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the IsleLife Media Limited Services and will terminate at the time you remove or IsleLife Media Limited removes such Content from the IsleLife Media Limited Services.
8. NO COMMERCIAL REUSE OF ISLELIFE MEDIA LIMITED SERVICES
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion or use of, or access to, the IsleLife Media Limited Services (including Content, advertisements, software and your membership to IsleLife Media Limited Services).
9. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT ISLELIFE MEDIA LIMITED AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, PHYSICAL DAMAGES TO PERSON OR PROPERTY, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ISLELIFE MEDIA LIMITED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (a) THE USE OR THE INABILITY TO USE THE ISLELIFE MEDIA LIMITED SERVICES; (b) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (d) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE ISLELIFE MEDIA LIMITED SERVICES; OR (e) ANY OTHER MATTER RELATING TO THE ISLELIFE MEDIA LIMITED SERVICES.
10. ISLELIFE MEDIA LIMITED'S PROPRIETARY RIGHTS
All media (downloaded or samples), software, text, images, graphics, user interfaces, music, videos, photographs, trademarks, logos, artwork and other Content, including but not limited to the design, selection, arrangement, and coordination of such Content on these Services is owned or licensed by or to IsleLife Media Limited, and is protected by copyright, trade dress, and trademark laws, and various other intellectual property rights laws. Except as expressly provided in these Terms of Use, no part of the Site and no Content may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated or transmitted in any way to any other computer, website or other medium or for any commercial purpose, without IsleLife Media Limited prior express written consent. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trade secrets, trade dress, rights of publicity or trademarks with respect to any of the Content, and IsleLife Media Limited reserves all rights not expressly granted hereunder. IsleLife Media Limited expressly disclaims all responsibility and liability for uses by you of any Content obtained on or in connection with these Services
11. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT: a. YOUR USE OF THE ISLELIFE MEDIA LIMITED SERVICES AND SOFTWARE ARE AT YOUR SOLE RISK. THE ISLELIFE MEDIA LIMITED SERVICES AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ISLELIFE MEDIA LIMITED AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. b. ISLELIFE MEDIA LIMITED AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE WILL MEET YOUR REQUIREMENTS; (ii) THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR AND HEREBY WAIVE ANY AND ALL CLAIMS AND CAUSES OF ACTION WITH RESPECT TO ANY DAMAGE TO YOUR COMPUTER SYSTEM, INTERNET ACCESS, DOWNLOAD OR DISPLAY DEVICE, OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ISLELIFE MEDIA LIMITED OR THROUGH OR FROM THE ISLELIFE MEDIA LIMITED SERVICES OR SOFTWARE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. e. A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE ISLELIFE MEDIA LIMITED SERVICE. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE ISLELIFE MEDIA LIMITED SERVICE. IMMEDIATELY DISCONTINUE USE OF THE ISLELIFE MEDIA LIMITED SERVICES AND CONSULT YOUR PHYSICIAN IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING THE ISLELIFE MEDIA LIMITED SERVICE: DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.
12. CONSENT TO OUR COMMUNICATION
By establishing a member account within these Services and providing an email address during the registration process you grant permission for IsleLife Media Limited to contact you at your e-mail address. By providing a phone number during the registration process you consent to receiving calls and text messages from IsleLife Media Limited
13. INDEMNITY
You agree to indemnify and hold IsleLife Media Limited and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through the IsleLife Media Limited Services, your use of the IsleLife Media Limited Services, your connection to the IsleLife Media Limited Services, your violation of the TOS, or your violation of any rights of another. If you fail to assume such defense, then IsleLife Media Limited may defend the action in any manner that it deems appropriate, and you agree to pay to IsleLife Media Limited all costs, including reasonable attorneys' fees, that we incur in effecting such defense in addition to any sum that we maybe required to pay by reason of any settlement or judgment against IsleLife Media Limited.
14. ISLELIFE MEDIA LIMITED PROPRIETARY RIGHTS
You acknowledge and agree that the IsleLife Media Limited Services and any necessary software used in connection with the IsleLife Media Limited Services contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in advertisements or information presented to you through the IsleLife Media Limited Services or by advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly permitted by applicable law or as authorized by IsleLife Media Limited or the applicable licensor (such as an advertiser), you agree not to modify, rent, lease, loan, sell, distribute, transmit, broadcast, publicly perform or create derivative works based on the IsleLife Media Limited Services, such Content or the Software, in whole or in part.' 'IsleLife Media Limited, IsleLIfe Media.com and Higlify.com are either trademarks or registered trademarks of IsleLife Media Limited. You may not copy, imitate or use them without IsleLife Media Limited prior written consent.
